Interpretation and Definitions
Interpretation
The words whose initial letters are capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Definitions
For the purposes of this Privacy Policy:
- Account means a unique account created for You to access our Service or parts of our Service.
- Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
- Application refers to CatKai, the software program provided by the Company.
- Apple refers to Apple Inc., the operator of the Apple App Store through which the Application is distributed and through which In-App Purchases are processed.
- Apple App Store means the digital distribution platform operated by Apple Inc. through which the Application is made available for download.
- Company (referred to as either "the Company", "We", "Us" or "Our" in this Privacy Policy) refers to CatKai.
- Country refers to: Switzerland
- Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.
- In-App Purchase means any digital content, feature, or subscription purchased within the Application through the Apple App Store payment infrastructure.
- Personal Data (or "Personal Information") is any information that relates to an identified or identifiable individual. We use "Personal Data" and "Personal Information" interchangeably unless a law uses a specific term.
- Service refers to the Application.
- Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
- Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
- You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
Collecting and Using Your Personal Data
Types of Data Collected
Personal Data
While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:
- Email address
- First name and last name
- Phone number
Usage Data
Usage Data is collected automatically when using the Service.
Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device's unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.
We may also collect information that Your browser sends whenever You visit Our Service or when You access the Service by or through a mobile device.
Information Collected while Using the Application
While using Our Application, in order to provide features of Our Application, We may collect, with Your prior permission:
- Information from your Device's phone book (contacts list)
- Pictures and other information from your Device's camera and photo library
We use this information to provide features of Our Service, to improve and customize Our Service. The information may be uploaded to the Company's servers and/or a Service Provider's server or it may be simply stored on Your device.
You can enable or disable access to this information at any time, through Your Device settings.
In-App Purchases and Payment Processing
The Application offers In-App Purchases processed exclusively through the Apple App Store. We do not directly collect, process, or store your payment card information or financial data.
When You make an In-App Purchase:
- Payment processing is handled entirely by Apple Inc. under Apple's own Privacy Policy and Terms of Service. Apple acts as the merchant of record for all In-App Purchases.
- Purchase receipts — Apple provides Us with a transaction receipt confirming the purchase (including product identifier, transaction ID, purchase date, and quantity). We use this receipt solely to validate and fulfill your purchase within the Application.
- Apple ID and account information — Apple may share limited account information with Us (such as a masked email address or Apple-assigned user identifier) as required to manage your subscription or restore purchases. We do not receive your full Apple ID credentials or payment method details.
- Subscription management — For auto-renewable subscriptions, Apple notifies Us of subscription status events (e.g., renewal, cancellation, upgrade) via server-to-server notifications. We process these notifications to maintain your access entitlements.
Data We receive in connection with In-App Purchases is used solely to:
- Validate and fulfill your purchase
- Restore previously purchased content
- Manage subscription entitlements
- Comply with legal and tax obligations
- Detect and prevent fraud
For questions about payment processing, billing disputes, or refunds, please contact Apple directly via https://support.apple.com. We do not have the ability to issue refunds for In-App Purchases — all refund requests must be submitted to Apple.
Apple's privacy practices are governed by Apple's Privacy Policy, available at https://www.apple.com/legal/privacy/.
Use of Your Personal Data
The Company may use Personal Data for the following purposes:
- To provide and maintain our Service, including to monitor the usage of our Service.
- To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.
- To process In-App Purchases: to validate purchase receipts received from Apple, fulfill purchased content or subscriptions, restore purchases, and manage entitlements.
- For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.
- To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including security updates, when necessary or reasonable for their implementation.
- To provide You with news, special offers, and general information about other goods, services and events which We offer that are similar to those that you have already purchased or inquired about unless You have opted not to receive such information.
- To manage Your requests: To attend and manage Your requests to Us.
- For business transfers: We may use Your Personal Data to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.
- For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.
We may share Your Personal Data in the following situations:
- With Service Providers: We may share Your Personal Data with Service Providers to monitor and analyze the use of our Service, to contact You.
- With Apple: We exchange transaction data with Apple as described in the In-App Purchases section above. Apple is an independent data controller for payment processing and is not a Service Provider acting on Our behalf.
- For business transfers: We may share or transfer Your Personal Data in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
- With Affiliates: We may share Your Personal Data with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy.
- With business partners: We may share Your Personal Data with Our business partners to offer You certain products, services or promotions.
- With other users: If Our Service offers public areas, when You share Personal Data or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside.
- With Your consent: We may disclose Your Personal Data for any other purpose with Your consent.
Retention of Your Personal Data
The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if We are required to retain Your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
Where possible, We apply shorter retention periods and/or reduce identifiability by deleting, aggregating, or anonymizing data. Unless otherwise stated, the retention periods below are maximum periods ("up to") and We may delete or anonymize data sooner when it is no longer needed for the relevant purpose.
- Account Information — User Accounts: retained for the duration of your account relationship plus up to 24 months after account closure to handle any post-termination issues or resolve disputes.
- Purchase and Transaction Records — In-App Purchase receipts and transaction records: retained for up to 7 years to comply with applicable tax, accounting, and financial record-keeping obligations under Swiss law and other applicable regulations.
- Customer Support Data — Support tickets and correspondence: up to 24 months from the date of ticket closure. Chat transcripts: up to 24 months for quality assurance and staff training purposes.
- Usage Data — Application usage statistics: up to 24 months. Server logs (IP addresses, access times): up to 24 months for security monitoring and troubleshooting purposes.
Usage Data is retained in accordance with the retention periods described above, and may be retained longer only where necessary for security, fraud prevention, or legal compliance.
We may retain Personal Data beyond the periods stated above for: legal obligation, legal claims, your explicit request, or technical limitations (backup systems scheduled for routine deletion).
When retention periods expire, We securely delete or anonymize Personal Data. Residual copies may remain in encrypted backups for a limited period and are not restored except where necessary for security, disaster recovery, or legal compliance.
Transfer of Your Personal Data
Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ from those from Your jurisdiction.
Where required by applicable law (including GDPR Article 46 and Swiss DSG), We will ensure that international transfers of Your Personal Data are subject to appropriate safeguards, such as Standard Contractual Clauses approved by the European Commission, adequacy decisions, or other legally recognized transfer mechanisms. The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy.
When You make an In-App Purchase, Apple may transfer Your payment and account data internationally in accordance with Apple's own privacy policy and transfer mechanisms.
Delete Your Personal Data
You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You.
You may update, amend, or delete Your information at any time by signing in to Your Account and visiting the account settings section that allows you to manage Your personal information. You may also contact Us to request access to, correct, or delete any Personal Data that You have provided to Us.
Please note, however, that We may need to retain certain information when we have a legal obligation or lawful basis to do so (for example, purchase records required by tax law). For deletion of data held by Apple in connection with In-App Purchases, please contact Apple directly.
Disclosure of Your Personal Data
Business Transactions
If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.
Law Enforcement
Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).
Other Legal Requirements
The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:
- Comply with a legal obligation
- Protect and defend the rights or property of the Company
- Prevent or investigate possible wrongdoing in connection with the Service
- Protect the personal safety of Users of the Service or the public
- Protect against legal liability
Security of Your Personal Data
The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially reasonable means to protect Your Personal Data, We cannot guarantee its absolute security.

If You are located in the European Economic Area (EEA), You have the following rights under the General Data Protection Regulation (GDPR):
Lawful Basis for Processing
We process Your Personal Data on the following legal bases:
- Performance of a contract (GDPR Art. 6(1)(b)): Processing necessary to fulfill your purchase, manage your account, and provide the Service.
- Legal obligation (GDPR Art. 6(1)(c)): Processing required to comply with applicable law, including tax and financial record-keeping requirements.
- Legitimate interests (GDPR Art. 6(1)(f)): Processing for fraud prevention, security, and service improvement, where such interests are not overridden by Your rights.
- Consent (GDPR Art. 6(1)(a)): Where We rely on consent (e.g., for marketing communications), You may withdraw consent at any time without affecting the lawfulness of prior processing.
Your GDPR Rights
You have the right to:
- Access (Art. 15): Request a copy of the Personal Data We hold about You.
- Rectification (Art. 16): Request correction of inaccurate or incomplete Personal Data.
- Erasure / "Right to be Forgotten" (Art. 17): Request deletion of Your Personal Data, subject to legal retention obligations.
- Restriction of Processing (Art. 18): Request that We restrict processing of Your Personal Data in certain circumstances.
- Data Portability (Art. 20): Receive Your Personal Data in a structured, machine-readable format and transmit it to another controller.
- Object (Art. 21): Object to processing based on legitimate interests or for direct marketing purposes.
- Withdraw Consent (Art. 7(3)): Where processing is based on consent, withdraw that consent at any time.
- Lodge a Complaint: Lodge a complaint with Your local data protection supervisory authority.

Swiss DSG — Your Rights Under Swiss Data Protection Law
If You are located in Switzerland, You have the following rights under the revised Federal Act on Data Protection (DSG / nDSG, in force since September 1, 2023):
- Right of Access (Art. 25 DSG): Request information about Personal Data We hold about You, including the source, purpose, and recipients.
- Right to Rectification (Art. 32 DSG): Request correction of inaccurate Personal Data.
- Right to Erasure and Restriction (Art. 32 DSG): Request deletion or restriction of processing of Your Personal Data, subject to applicable exceptions.
- Right to Data Portability (Art. 28 DSG): Where technically feasible, receive Your Personal Data in a structured, machine-readable format.
- Right to Object (Art. 30 DSG): Object to automated individual decision-making that has legal or similarly significant effects on You.
- Right to Lodge a Complaint: Lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC) at https://www.edoeb.admin.ch.
The Company is based in Switzerland. For cross-border data transfers to countries without an adequate level of data protection recognized by Switzerland, We rely on appropriate safeguards such as standard contractual clauses approved by the FDPIC or the European Commission (recognized as equivalent under Swiss law where applicable).

CalOPPA — California Online Privacy Protection Act
Pursuant to the California Online Privacy Protection Act (CalOPPA), We make the following disclosures:
- We agree to CalOPPA's requirements and will not change Our information-collection and use practices without first altering this Privacy Policy.
- Our Privacy Policy link is clearly posted and accessible from the Application and related websites.
- Users can update or correct their Personal Data by contacting Us or visiting their account settings.
- Do Not Track: Our Service does not currently respond to Do Not Track (DNT) browser signals. We will update this policy if Our practices change.
- We do not permit third parties to collect personally identifiable information about individual users' online activities over time and across different websites when those users use Our Service, except as described in this Privacy Policy.
CCPA and CPRA — California Consumer Privacy Rights
If You are a California resident, the California Consumer Privacy Act of 2018 (CCPA) as amended by the California Privacy Rights Act of 2020 (CPRA, effective January 1, 2023) grants You specific rights regarding Your Personal Information.

We do not collect Social Security numbers, driver's license numbers, financial account numbers, health data, biometric data, or precise geolocation for advertising purposes.
Sources of Personal Information
We collect Personal Information directly from You, automatically from Your Device when You use the Service, and from Apple in connection with In-App Purchases.
Business or Commercial Purposes for Collection
We collect Personal Information for the purposes described in the "Use of Your Personal Data" section above.
Categories of Third Parties With Whom We Share Personal Information
We may share Personal Information with: Service Providers (for service operation and analytics), Apple (for In-App Purchase processing), and as required by law.
Your California Privacy Rights
Right to Know (CCPA § 1798.100): You have the right to request that We disclose what Personal Information We have collected about You, including the categories, specific pieces, sources, purposes, and third parties with whom We share it.
Right to Delete (CCPA § 1798.105): You have the right to request deletion of Personal Information We have collected from You, subject to certain exceptions (e.g., legal obligations, completing a transaction).
Right to Correct (CPRA § 1798.106): You have the right to request correction of inaccurate Personal Information We maintain about You.
Right to Opt-Out of Sale or Sharing (CCPA § 1798.120 / CPRA § 1798.120): We do not sell Your Personal Information for monetary consideration. We do not share Your Personal Information for cross-context behavioral advertising. You therefore do not need to submit an opt-out request, but You may contact Us to confirm this at any time.
Right to Limit Use of Sensitive Personal Information (CPRA § 1798.121): To the extent We process "sensitive personal information" as defined by CPRA (including precise geolocation and photos/camera data), We use such data only for the purposes for which it was collected (providing Application features) and do not use it to infer characteristics about You for unrelated purposes.
Right to Non-Discrimination (CCPA § 1798.125): We will not discriminate against You for exercising any of Your CCPA/CPRA rights. We will not deny You the Service, charge different prices, or provide a different level of quality because You exercised Your privacy rights.
Authorized Agent: You may designate an authorized agent to submit CCPA/CPRA requests on Your behalf. We will require written verification that the agent is authorized to act on Your behalf.
How to Submit a California Privacy Request
To submit a Right to Know, Right to Delete, or Right to Correct request:

We will respond to verifiable consumer requests within 45 days. If We require more time (up to 90 days total), We will inform You of the reason and extension period in writing. We will not charge a fee for a reasonable request but may charge a reasonable fee for excessive or repetitive requests.
We must verify Your identity before fulfilling a request. We will ask You to provide information sufficient to verify You are the person about whom We collected Personal Information.
Children's Privacy
Our Service does not address anyone under the age of 16. We do not knowingly collect personally identifiable information from anyone under the age of 16. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 16 without verification of parental consent, We take steps to remove that information from Our servers.
If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require Your parent's consent before We collect and use that information.
Under COPPA (for users in the United States), We do not knowingly collect Personal Information from children under 13. Under GDPR, We do not knowingly collect Personal Information from children under 16 without verified parental consent.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page.
